1. Definitions
For the purposes of these Terms and Conditions:
- "silveroks," "we," "us," or "our" refers to the senior living residence operated at Jalan Ampang 142, Kuala Lumpur, Malaysia.
- "Resident" refers to any individual receiving residence services at silveroks.
- "Family Member" or "Authorized Representative" refers to individuals designated by the Resident to receive information and make decisions on their behalf.
- "Services" refers to accommodation, meals, activities, and support provided by silveroks.
- "Agreement" refers to the residence contract between silveroks and the Resident or Authorized Representative.
2. Acceptance of Terms
By using our website, submitting inquiries, or entering into a residence agreement with silveroks, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services or website.
These terms constitute a legally binding agreement under Malaysian law. Individuals entering into residence agreements must be at least 18 years of age or have a legal guardian or authorized representative.
3. Services Description
silveroks provides senior living residence services in Kuala Lumpur, including but not limited to:
- Private living quarters furnished according to residence tier
- Three daily meals prepared on-site
- Housekeeping and laundry services
- Access to common areas and facilities
- Daily living assistance as specified in residence agreement
- Activity programs and social opportunities
silveroks does not provide medical treatment or healthcare services. We are not a medical facility and do not have licensed medical staff on premises. Residents requiring medical care must seek services from appropriate healthcare providers.
4. Residence Application and Admission
Admission to silveroks is subject to availability and completion of our application process, which includes:
- Initial consultation to discuss needs and preferences
- Completion of residence application form
- Review of any relevant health or support information
- Tour of our facility and discussion of available residence options
- Execution of residence agreement upon mutual acceptance
We reserve the right to decline applications if we determine that we cannot adequately meet an applicant's needs or if acceptance would negatively impact other residents.
5. Fees and Payment Terms
Residence fees are based on the selected residence option (Community Living, Enhanced Comfort, or Premium Independent Living) and are payable monthly in advance. Current rates are:
- Community Living Residence: RM 2,950 per month
- Enhanced Comfort Residence: RM 6,800 per month
- Premium Independent Living: RM 11,400 per month
Payment is due on the first day of each month. Late payments may incur fees as specified in the residence agreement. We accept payment by bank transfer, check, or other methods as agreed upon. Fees are subject to periodic review and adjustment with 60 days' advance notice to residents and families.
6. Resident Responsibilities
Residents agree to:
- Treat staff, other residents, and visitors with respect and courtesy
- Comply with silveroks policies and community guidelines
- Provide accurate information regarding health status and support needs
- Maintain personal living areas in reasonable condition
- Respect the privacy and quiet enjoyment of other residents
- Inform staff of any changes in health status or care requirements
- Participate in regular reviews of residence arrangements and services
7. silveroks's Responsibilities
silveroks commits to:
- Provide services as outlined in the residence agreement
- Maintain safe, clean, and comfortable living environments
- Treat all residents with dignity and respect
- Protect resident privacy and confidentiality
- Communicate openly with residents and authorized family members
- Address concerns and complaints in a timely manner
- Maintain appropriate insurance coverage for our operations
8. Modification of Services
As resident needs evolve, silveroks may recommend changes to residence tier or support levels. Such changes require mutual agreement between silveroks and the Resident or Authorized Representative. If a resident's needs exceed what we can appropriately provide, we will work with the family to identify more suitable arrangements and support a smooth transition.
9. Termination
Either party may terminate the residence agreement with appropriate notice:
- Residents or Authorized Representatives may terminate with 30 days' written notice
- silveroks may terminate with 60 days' written notice if resident needs cannot be adequately met
- silveroks may terminate immediately for nonpayment after appropriate notice, serious policy violations, or behavior that threatens safety
- Termination due to resident death is effective immediately with no further fees owed
Upon termination, any prepaid fees will be prorated. Personal belongings must be removed within 14 days of termination.
10. Liability and Indemnification
silveroks maintains appropriate insurance and takes reasonable precautions to protect resident safety. However, we cannot be held liable for:
- Loss or damage to personal property (residents should maintain personal insurance)
- Medical conditions or health changes not directly caused by our negligence
- Injuries resulting from resident's refusal to follow reasonable safety guidelines
- Events beyond our reasonable control (force majeure)
Our liability for damages is limited to the amount paid in residence fees during the preceding three months, except where Malaysian law prohibits such limitation.
11. Privacy and Confidentiality
We handle all personal information in accordance with our Privacy Policy and Malaysia's Personal Data Protection Act 2010. Resident information is kept confidential and shared only with authorized individuals and as required by law.
12. Visiting and Communication
Family members and visitors are welcome at silveroks during reasonable hours. We maintain flexible visiting policies while respecting the community environment and other residents' needs. Specific visiting arrangements are detailed in the residence agreement.
13. Website Use
Our website is provided for informational purposes. While we strive for accuracy, information on the website may not always reflect current availability, pricing, or services. We reserve the right to modify website content without notice. Unauthorized use of our website or attempts to interfere with its operation are prohibited.
14. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of silveroks and protected by Malaysian intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
15. Dispute Resolution
In the event of any dispute arising from these terms or residence services, parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through mediation before pursuing litigation. Any legal action must be brought in the courts of Kuala Lumpur, Malaysia, and will be governed by Malaysian law.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid under Malaysian law, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it will be severed from these terms. The remaining provisions will continue in full force and effect.
17. Modifications to Terms
silveroks reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated to residents and authorized family members with reasonable advance notice. Continued residence after such notice constitutes acceptance of modified terms. The most current version will always be available on our website.
18. Entire Agreement
These Terms and Conditions, together with the residence agreement and our Privacy Policy, constitute the entire agreement between silveroks and residents or their representatives. Any modifications must be made in writing and signed by both parties.
